[The vicarious liability of tutors and teachers of art] The paper’s aim is to depict, through case law, the current responsibility of tutors and teachers of art for the offense committed by their students. Although art. 2048 Code Civil provides, for both tutors and parents, the burden of proof release if they were unable to prevent the event, examination of the decisions allows to identify a tendency to make the judgment on the existence of the fault of tutors “in vigilando”, on the basis of objectively verifiable criteria.
