On the way of Rhythm. When art there is, the artwork's form retains trace of that art like a movement. In Aesthetics this process is named ‘formativity’, but it can also be defined as ‘openness to the transformation’ which also means ‘openness to the otherness.’ The idea of form as ‘configuration constantly mutable’ is conserved in the original notion of rhythmos. My aim is, first, recovering this concept, starting from reconstruction of the rhythmos' term offered by Benveniste in 1951; second, elaborating this notion in the light of Maldiney’s theory on Aesthetics of the rhythms (1967); and, finally, considering if this reformulated concept of form could be useful in the legal field to face both the formalistic drift of the juridical system and the exorbitant increase of new orders and forms.
