The Directive 2012/29/UE is the most important act for the protection of the victim. It requires the introduction of Restorative Justice measures in the legal system of the Member States, in order to preserve the foundamental rights of the criminal victim, in addiction to the damage compensation. After analysing the Restorative Justice nature and identifying the related National Institutions, the Author emphasizes some inconsistencies beetween the Restorative Justice principals and the Costitutional ones. Then the Author analizes Italian law and suggests solutions to the inconsistencies even compatible with a iure condendo perspective.
