Abstract

The work suggests a procedure analysis for granting citizenship, in Roman times and nowadays, through the performance of military service, with the extension of women's privilege joined to the soldiers and to their children. The epigraphic sources (military diplomas, papyri...) through the information on the subject can be obtained, distinguishing between the Republican and Imperial periods, have been examined and the differences between the various forces of the army (legionaries, auxiliaries, courts of Rome...) have been analyzed, especially with reference to the vexata quaestio on the ban of military marriage. It has also taken into account the legal and literary sources, as well as the theories formed respecting this. On the topics dealt with, an attempt was made to provide new probable keys to interpretation, according to a different approach to the sources, evaluating both legal, social and economic aspects. Moreover, In the first sequence, a preliminary comparison has been made on the concept of multilevel citizenship deriving from the measure of granting citizenship (to all the inhabitants of the Empire) by Caracalla with Constitutio Antoniniana in 212 A.D., and the current European citizenship, looking for possible points of contact and/or answers to the current problems afflicting the European Union, which is increasingly compared to the Roman Empire. Finally, it has been proposed a brief examination of modern legal systems for granting citizenship through military service, with a focus on Italian legislation and also on the prohibition of marriage for military personnel.
