This work – which was partly granted by Regione Marche and Marche Multiservizi Spa - analyzes the impact of Public Contracts Code introduced by Legislative Decree 19/04/2016 n. 50 according to the EU Directives 2014/23/UE, 2014/24/UE, 2014/25/UE. This legislation has important consequences not only from the legal point of wiew - with regard to a simplification of the tender procedures -, but also from the economic and social point of wiew. Indeed, in the Italian economy, public procurement accounts for ca. 11% of the gross domestic product and 30% of national public expenditure. At the same time the regulation of public contracts has a strong impact on citizens’ life because the public evidence procedures aim at carrying out works, services or supplies of public utility which, if not carried out promptly, will negatively affect the ultimate direct or indirect recipients, i.e.the citizens. Hence, considering the great importance of the public procurement discipline, this Ph.D. thesis aimed at answering - also through phone interviews and an on-line questionnaire submitted to a selected sample of public contracting authorities - a simple but relevant question: did the Legislative Decree n. 50/2016 and successive modifications improve the sector regulation and functioning or did they result in an overall worsening?
