Taking the cue from the recent modification of art. 41 of the Constitution, which explicitly defines health and environment as limits to private economic initiative, the essay attempts to analyze the relationship between the protection of the working environment and the environment outside the enterprise, focusing attention on the uncertain effectiveness of the provisions of the d.lgs. n. 81/08 which refer to the protection of the health of population and the integrity of environment. In view of the growing importance of an integrated dimension of prevention, it proposes to enhance, to this end, the common approach of environmental and safety at work management systems and, in particular, the rules gover- ning the organization and management models as means of exempting companies from administrative responsibility.
