Abstract [It]: Il presente contributo si pone l’obiettivo di indagare il complesso tema del fine vita, muovendo dalla perdurante inerzia del legislatore italiano dopo il caso Cappato, ragionando sulla ricaduta sostanziale in termini di tutela dei diritti. Tenendo in considerazione le più recenti evoluzioni nel panorama italiano che hanno portato alla sentenza 135/2024, si vuole inoltre esaminare le legislazioni più avanzate e più recenti nel continente europeo. Abstract [En]: This paper deals with the complex issue of the end of life, starting from the persistent inertia of the Italian legislator after the “Cappato case” and reasoning on the substantial impact in terms of the protection of rights. The paper also examines the most recent developments in the Italian that led to dec. n. 135/2024 and the most advanced legislation on the European continent.
